Important news for those following the latest updates on the FGTS. On Thursday, the 27th, there will be a new session of the Federal Supreme Court (STF) that may bring about possible changes in the rate of FGTS correction.
You can follow it on TV Justiça, on the STF YouTube channel (@STF_oficial) or on Rádio Justiça. The trial has already taken place on three other occasions (2019, 2020 and 2021), but the decision had to be postponed on all of them.

However, now, expectations are high and the financial market will be watching the unfolding of this novelty.
The trial was the result of a lawsuit that began in 2012. At the time, the Solidarity Party questioned the use of the Referential Rate (TR) to monitor inflation.
It is an important discussion, because the accumulated losses between 1999 and 2013 were estimated at R$27 billion, generating enormous damage to Brazilian workers.
Since 2019, the progress of processes that are linked to the correction of the FGTS has been suspended throughout Brazil. This decision was taken by Justice Roberto Barroso, rapporteur of the case at the STF.
The good news is that, according to lawyer João Badari, there is an expectation that the Supreme will opt for the application of another inflation index, similar to the judgment of precatorios.
The Federal Supreme Court (STF) decided that the FGTS correction may favor several people from different groups.
However, the question arises: who can be favored? The Court will determine who will be contemplated with this modulation, taking into account the period and amounts involved.
The good news is that, regardless, many workers will benefit from this important decision.
If there is a decision favorable to the workers, the STF will establish some criteria, such as the period to be considered, which can be from 1999 or the date of the STF decision.
This decision will apply to both active and inactive FGTS accounts. Additionally, another relevant issue is whether the decision will cover all workers.
