How does the negation of a debtor's name work?

The attitude of submitting a client's name to credit protection bodies is carried out by companies that, after some negotiation attempts, ended up not receiving the expected return, which is the full payment of the balance debtor.

In general, before “dirtying” the consumer's name, companies try to get in touch with the customer, offering a longer term or various special conditions and discounts for the debt to be paid off.

But, after all, what are the consequences of having a dirty name?

Among the main problems of having your name included in credit protection agencies is, obviously, the difficulty in obtaining credit. Be it a credit card at a store, applying for a credit card or a higher limit, as well as loans or financing.

Also according to information from Serasa, the average debt balance of citizens with a dirty name is approximately R$ 4,000. Therefore, because they are smaller, these debts are not so difficult to pay off. Usually, the greatest difficulty is precisely in preventing the request for credit.

However, in some cases, when the customer has high debt amounts, material assets such as real estate and vehicles may be seized by the courts until the debt is paid. However, it is worth noting that there are exceptions to this situation, such as, for example, if the property is the only one owned by the family, the Court cannot block it.

In addition, the amount that the debtor has in financial institutions can be used to settle the amounts owed, when the injured company files a debt payment in court. However, salary and savings cannot be pawned.
