This unusual situation happened in the Federal District. On June 29, many drivers were surprised to see their names displayed on a list of DMV violators. This list was published in the Official Gazette of the Federal District, and all the accused were convicted of driving while intoxicated.
In addition, the Diário informs that they had their wallets suspended. The DMV also stated that it already had all the evidence against the drivers. This means that none of them had any possibility of defense before the law.
However, it is possible to file an appeal against the conviction in at least 30 days at the Administrative Board of Appeals and Infractions of the DF (Jari). Then, the case may undergo a reassessment and the possible arguments of the drivers will be heard.
Prohibition is present in Article 165 of the Brazilian Traffic Code. In case of flagrante delicto, the Law determines that the driver must pay at least R$ 2,934.70, but this amount may increase if there are other occurrences. In addition, there is also a determination regarding the suspension of the CNH.
Finally, it is worth remembering that the law does not apply only to alcoholic beverages, but to any and all psychoactive substances that alter consciousness while driving.
