Who has the right?

Workers with a formal contract who had an available balance in their FGTS accounts on December 31, 2021 are entitled to the profit share. Similarly, the correction of values ​​always happens on that date, and is applied to any value.

Thus, even if the amount available in the account on that date was R$ 1, the worker will have this amount corrected according to the interest rate. But clearly, the greater the amount available on that date, the greater the profit.

However, even if everyone is entitled to this amount, the FGTS withdrawal is not always available. That is, as determined by legislation, withdrawals can only take place when the following conditions are met:

• The worker has been unemployed for three years with a formal contract;
• End of temporary contract;
• To carry out the purchase of a home;
• Dismissal without just cause.

According to Law 13,446/17, responsible for governing the correction of the FGTS, there is a maximum period for the payment of this amount. This period runs until August 31 of the year following the correction year, in this case, the 2022 withdrawal refers to the 2021 corrections.
