Proposed by deputy Pompeo de Mattos (PDT-RS), PL 4.367/2020, which is being processed in the Chamber, may have greater ease in being approved. Arising from a legislative suggestion by lawyer Sandro Lúcio Gonçalves, it determines the payment of the 14th salary in two installments.
The first part of the payment was expected to be made available in March of this year, referring to 2020, and the other would be paid in 2023, referring to 2021. However, as the Government anticipated the deposit of the 13th installment again this year, the project may still undergo changes to include one more installment.
In addition, now in the Senate, bill 3.657/2020, authored by Senator Paulo Paim (PT-RS), is also being processed. It determines the availability of only a portion of the 14th salary, in reference to the year 2020.
The two projects clarify that the extra bonus needs to be put into practice due to the anticipation of the 13th of the INSS in recent years. With advance payments, retirees and pensioners were left without an extra amount at the end of the year, a time when Brazilians have more expenses.
Each PL determines a different calculation for the 14th salary. The bill in the Chamber establishes that the amount must be from one to two minimum wages (R$ 1,212 to R$ 2,424, currently), differing according to the value of the regular benefit. Already the PL in the Senate establishes the same value as the regular benefit.
In addition, insured persons eligible to receive the 14th of the INSS are those who are entitled to the 13th salary. That is, retirees, pensioners and beneficiaries of accident assistance, temporary disability assistance (formerly sickness assistance) and imprisonment assistance.
