The Public Ministry of the Federal District and Territories (MPDFT) initiated an investigation against the two companies involved. Therefore, Serasa would have passed information to another company collaborating with blocking the devices of people registered as defaulters.
This block would prevent the use of many features on the debtor's cell phone, and it would only be possible to make emergency calls, as this was provided for in the contract. Furthermore, an MPDFT and Prodecon promoter commented that some devices are completely blocked, without any permission to use them.
The company SuperSim does not deny its participation in this action and even says that everything is in legal compliance. However, Serasa says that it has no involvement with the suspicious attitude and that it does not act in collusion with the aforementioned company.
Consumer protection prosecutors are investigating allegations that Serasa and SuperSim used cell phones from debtors as collateral in the event of non-payment of loan installments that they were releasing to their customers.
Blocking is done remotely and debtors can only make emergency calls. On their websites, both Serasa and SuperSim confirm the possibility of blocking cell phones as a loan payment guarantee.
In both cases, a loan of up to BRL 2,500 is required for Android devices. Therefore, the two credit operators require the installation of the company's application.
In a statement, the Ministry of Justice confirmed that it will formally communicate all the companies that are related to the case, including Serasa, so that they can give part of their defense. Senacon's General Coordination of Technical Consultancy and Administrative Sanctions (CGCTSA) will investigate the narrated facts.
In this way, the appropriate institutions will respond regarding the cell phone blocking systems that were used. In addition, they will also answer about the situations that caused the limitation of the services available on each device.
