The precatório modality includes the collection of amounts greater than 60 minimum wages per beneficiary, that is, approximately R$ 72,720 thousand with the base year 2022. The numbers refer to the judicial processes by which the Public Treasury was condemned.
The precatory payments
The amount of money that was made available for transfers was restricted this year due to the determination of the Precatorios PEC. The initial amount of R$ 32.4 billion was released by the Federal Government for the payment of precatories, even for those related to INSS beneficiaries.
However, the amount requested by the judiciary was 25% short of the expected amount for the settlement of debts. Thus, the amount released was R$ 25 billion that will be distributed to 196,019 beneficiaries originating from a total of 115,392 lawsuits.
Payment priorities
Priority is specifically given to some people who will receive precatory payment, namely: the disabled, food records, individuals with serious illnesses and the elderly. Along with the shareholders, the lawyers of the process will also be receiving.
When will the payment of the INSS precatories be made?
The beginning of transfers was scheduled for the last day of August, but only a few TRFs used the date in question. Therefore, now in September, the other beneficiaries will receive the amounts according to the payment schedule that was published from July 2, 2020 to July 1, 2021.
Of the amount passed on by the Federal Justice Council, R$ 11.2 billion is delivered to the TRF to allocate to the elderly and pensioners. As a result, this group will receive a total of more than R$72,000 in court payments related to disability and assistance benefits.
