Changes are also proposed to increase penalties for crimes committed with firearms, improve the confiscation of proceeds from crime and allow the use of property seized by public security agencies.
Among the amendments are the hardening of the sentence for crimes considered more serious. For example: theft, corruption and embezzlement which, according to the proposal, is now in a closed initial regime. The text determines that appeals filed against the decision that led the defendant to prison will not have suspensive effect. That is, the defendant will remain in prison while the appeals are analyzed by the Justice, unlike what happens today.
Changes in legislation further strengthen the role of the jury courts so that the decision is enforced immediately. The change, according to the government, follows the understanding of the Federal Supreme Court (STF), which considered the verdict of the sovereign jury court.
In the case of convictions for offenses with a maximum penalty of more than six years imprisonment, confiscation of assets corresponding to the difference between the value of the convict's assets and that which is compatible with his income licit. The information is from the Federal Senate.
