Who is entitled to receive maternity assistance?

This benefit is intended for mothers and fathers who need to be absent from work due to the arrival of a child. It is also worth mentioning that the Law guarantees that the right is also paid in cases of adoption, non-criminal abortion and stillbirth, which is when the baby dies before birth. In all these situations, workers will be removed with the guarantee of their wages.

However, there must be at least 10 contributions in the last year for the INSS to guarantee the salary, with the exception of domestic servants and casual workers, who are exempt from the grace period. In addition, the salary can also be paid to the children's parents, provided they follow the same birth or adoption conditions, and are also insured by the INSS.

For how long must the salary be paid?

The payment of the Maternity or Paternity Salary varies according to the situation in which it will be paid. That is, fathers and mothers of stillborn children will have a certain time, whereas in the case of abortion, the period is different. It is even worth mentioning that in these situations, it will be necessary for the same to happen within the law due to rape or malformation. In this case, in particular, the aid will be paid for less time, as it is a relatively simple procedure. Check the periods:

  • Non-criminal abortion or in cases provided for by law: 14 days;
  • Adoption: 120 days;
  • Stillborn fetuses: 120 days;
  • Judicial custody for adoption purposes: 120 days;
  • Childbirth: 120 days.

To request the salary, the interested party will need to contact the INSS through the channel that is closest to him. Such as, for example, the Meu INSS application or through the official line for requests, through the number 135.
