What is maternity pay?

Although the name is similar to maternity leave, these are different benefits. This is because the leave is the act of being able to leave work, while the maternity salary is the value provided in some specific conditions.

Thus, these become complementary benefits. Therefore, when there is the birth of a child, adoption or miscarriage, the person can be removed on leave and receive the maternity salary.

Who is entitled to maternity pay?

First, as it is a benefit paid by the INSS, the person needs to be insured by the agency. That is, it is necessary to have a portfolio, be an independent worker or special insured person, as long as they contribute to the INSS.

However, if the taxpayer is optional, it is necessary to have made at least 10 payments to the INSS before requesting the benefit. In addition, it is essential to meet one of the criteria, in which assistance is only accepted for the following cases:

  • Birth of child(ren);
  • Adoption;
  • stillborn fetuses;
  • Non-criminal abortions;
  • Judicial custody for adoption purposes.

The duration of the benefit varies between 14 and 120 days. In situations of abortion, the deadline for receiving financial assistance is for a minimum period, and in other conditions, it is valid for 4 months.

How to receive assistance?

Now that you've seen the criteria and know if you meet the requirements, it's time to apply for the benefit. It is possible to apply for assistance up to 28 days before childbirth or up to 3 months after that date.

Currently, the request for maternity pay can be made from your own home, through the “Meu INSS” application, available for Android and iOS. Download it from your cell phone store, access the program and search for the “Maternity salary” option.

Then click on “Request”, then look for “Agendamento” and enter your Individual Taxpayer Registration (CPF) number. Now fill in all the fields and your application will go to the INSS.
