New diseases join the INSS sick pay list

Recently, the National Institute of Social Security (INSS) included two illnesses on the free list. According to the law, at least 12 contributions are required to be entitled to sickness benefit and disability retirement. As of next Monday, the 3rd, the two new illnesses will already be listed on the list that entitles you to the benefit, without the obligation of a minimum grace period of 12 months.

We are talking about stroke (acute) and acute surgical abdomen.

Vascular accident, better known as stroke, occurs when blood vessels break or clog. With this, a paralysis is caused in the part of the brain that has stopped circulating blood. Acute abdomen is characterized by abdominal pain and tenderness that may appear suddenly or progressively. As the name already says, you need a surgical procedure to resolve the issue.

This decision was taken by the Ministry of Labor and Social Security in harmony with the Ministry of Health. The discussion came to an end in September. This decision was published in the Federal Official Gazette. According to the legislation, the worker who becomes incapacitated to work is only entitled to sick pay or disability retirement after having made at least 12 payments to the INSS after becoming affiliate.

Benefit access exceptions

We see some caveats when the worker (whether self-employed or with a formal contract):

• Develops one of the illnesses on the list;
• Suffers an accident of any nature or cause;
• He is the victim of an occupational disease directly linked to the work area.

For the listed diseases, the grace period is only valid for those who contract them after contributing to the INSS.

List of diseases that entitle the benefit without requirement of contribution

• Surgical acute abdomen (new);
• Acute stroke (new);
• Blindness;
• Malignant neoplasm;
• Active tuberculosis;
• Leprosy;
• Severe mental disorder (provided you are attending with mental alienation);
• Severe heart disease;
• Irreversible and disabling paralysis;
• Parkinson's disease;
• Severe nephropathy;
• Severe liver disease;
• Multiple sclerosis;
• Radiation contamination, based on conclusion of specialized medicine;
• Advanced stage of Paget's disease (osteitis deformans);
• Acquired immune deficiency syndrome (AIDS).

Finally, it is important to remember that, if the illness that the worker has is outside this list, the months of contribution to the INSS become mandatory. There will be no type of exemption from this duty.
