Do all retirees have the right to exemption?
Unfortunately not. Therefore, as there is no federal law in the constitution to ensure this right nationally, each municipality is responsible for implementing its own rules regarding INSS retirees. Although many cities adopt this type of exemption, not everyone uses this rule.
If the municipality adopts the rule, is the exemption total?
It is necessary to consult in advance, the fact that the municipality implements the exemption for INSS retirees does not mean that this discount is 100%. Some municipalities will establish factors that determine the discount percentage, such as the amount received in retirement, age and the value at which the property is appraised.
This is the case of the municipality of São Paulo, the exemption occurs if retirees receive up to 3 minimum wages and the property (in their name) must not exceed the value of R$1,310,575. In Rio de Janeiro, in addition to retirement having a maximum value of 3 salaries, the age of the beneficiary also influences, retirees must be over 60 years old.
Partial exemptions also occur, the discount is 50% on the tax applied to those who earn 3 to 4 minimum wages. Finally, retirees with earnings above 4 and 5 minimum wages, the IPTU exemption drops to 30%.
