According to the decision of judge Cláudia Helena Batista, credit card operating companies are obliged to interrupt the processing of refund requests submitted by consumers who did not receive the contracted services before the company entered the recovery process judicial.
The judge maintains that these refunds will be managed within the context of the company's judicial recovery plan. 123miles, which is currently on hold.
In this sense, the company argued that several refund requests were made inappropriately, a a fact that, from the judge's perspective, is not in line with the principle of equality between creditors.
However, 123milhas' request to force hotels and ticket intermediaries to comply with the contracts was rejected by the judge.
Therefore, according to its analysis, this measure would impact several suppliers and third parties involved, without taking into account the particularities of each contract.
The decision establishes the creation of a mediation process that involves the Ministry of Justice, Banco do Brasil and the Senacon (National Consumer Secretariat), which must issue positions regarding the determinations judicial.
The 123milhas judicial recovery process remains suspended, pending the analysis of pending emergency measures in accordance with the same decision.
The company filed the request in August, declaring a debt of at least R$2.308 billion and involving the companies HotMilhas and Novum, with the subsequent inclusion of MaxMilhas.
MaxMilhas' estimated debt of R$226 million was not included in the initial request. Finally, in September, the judicial recovery of 123milhas was temporarily interrupted at the request of Bank of Brazil, one of the creditors of the travel company, due to the failure to provide the necessary information by the debtor parties.
