Resources from inactive programs, previously unavailable, can be reused for other purposes in the education sector. This is what the complementary bill (PLP) 48/2023 proposes, authored by senator Laércio Oliveira (PP-SE), approved this Tuesday (7) by the Economic Affairs Committee (CAE) of the Federal Senate, which now goes to the Plenary.
The initiative, in fact, ‘goes against’ the determination of the Fiscal Responsibility Law (Complementary Law 101, of 2000), which prohibits expressly the use of resources transferred by the Union to states and municipalities ‘in actions different from those originally foreseen’. The ban would be maintained, including in the case of inactive programs or whose resources were banned.

According to the proposition – approved with an amendment from the Education and Culture Commission (EC) – inactive resources may be necessarily used in the maintenance and development of teaching, which, according to the Education Guidelines and Bases Law (LDB- Law 9,394, 1996), would include expenses with construction and maintenance of schools, remuneration of education professionals and acquisition of material didactic.
According to Oliveira's calculations, in April 2022, there was a balance of around R$308.4 million in resources related to programs inactive in the area of education, while many states and municipalities do not have financial resources for works and actions educational. “The incorporation of the project into our legal system will allow these works to be resumed for the benefit of the population”, highlights the author of the proposal.
When writing a favorable opinion, rapporteur Damares Alves (Republicanos-DF) assesses that, despite the efforts carried out in the last decade, Brazilian education continues to present deficiencies and a great demand for investments. “Resources that may be ‘pooled’ in extinct programs cannot be ignored: we need to promote their reallocation in the fastest and most efficient way possible to guarantee use in other activities to promote education”, argues.
In another impact initiative, CAE also approved, this Tuesday (7), authorization for the National Bank of Economic and Social Development (BNDES) contracts an external loan of up to US$500 million from the New Development Bank (Banco do BRICS).
The resources go to the BNDES Climate Program, which aims to finance projects to reduce greenhouse gas emissions and actions to adapt to the effects of climate change.
