In response to its customers, the bank has only informed that it is aware of the problem and that “the incident will soon be resolved”. According to the president of Procon-RJ, Cássio Coelho, the consumer needs to contact the bank's Consumer Service (SAC) and dispute the absence of amounts in the account.
In addition, you will need to write down the protocol and save the screen print, if the dispute is carried out digitally. Even if the bank has informed that the problem will be resolved soon, the consumer has the right to know within what period the issue will actually be resolved.
According to Proteste's lawyer, Adriano Fonseca, “it is important, in this contact, to record the amount withdrawn from the account and all the inconvenience that this practice caused. In addition to receiving this amount back, any other problem caused by this failure must be repaired to the consumer.”
However, if the consumer does not suffer losses beyond the inconvenience, compensation will not be paid. The right concerns delays in paying bills due to missing money. “Consumers who are unable to pay their bills, for example, can demand that Bradesco pay any interest and fines they suffer. Furthermore, possible moral damages can be observed if the situation causes any type of embarrassment to the consumer”, he explains.
The same goes for transactions via PIX denied due to lack of balance in the account. Procon-RJ identifies that there is a failure in the provision of banking services and that the financial institution must be responsible for the damages caused. Therefore, it is extremely important that the consumer documents the denial of the transaction, informs the bank and keeps the receipts.
When the loss is proven, the customer may request compensation in court. Finally, the improper withdrawal of funds from consumers' bank accounts is an abusive practice and poor provision of banking services.
