The new rules for wearing helmets are already in effect, and you must follow them to avoid paying fines or having your license suspended. Therefore, from now on, the helmet must have a certificate from the National Institute of Metrology, Quality and Technology (Inmetro), in addition to retro-reflective components on the sides and back.
Another point of the text is that, when using the helmet, the pilot must keep it fixed on the head using a combination of hitch and jugular strap, just below the lower part of the jaw. In addition, the requirement to use helmets that have a visor remains valid. In the absence of this protection item, protective eyewear in good condition must be provided to the motorcyclist.
If a driver or passenger violates the rules, they will face administrative penalties as outlined in the CTB. The first one states that if the pilot does not have the necessary qualifications or does not have protective head equipment, he will receive a self-suspension infraction.
With that, regardless of the number of points in the wallet, your National Driver's License (CNH) will be suspended. In addition, the motorcyclist must pay a fine of R$ 293.47.
Another penalty may be imposed on a driver who wears his helmet outside the resolution's rules. In practice, this is a serious infraction that requires the payment of a fine of R$ 195.53.
