Law 14.229/2021 brought updates to the Brazilian Traffic Code (CTB) in October 2021. However, among these, most are already valid and the other will only be valid from January 2024. Regarding this change, it should be noted that it changes article 99 of the original text of the Brazilian Traffic Code. This makes the action more flexible only when the load limit is exceeded at the time of weighing. However, there is a tolerance of 5%, in the case of vehicles carrying biodiesel, this percentage changes to 7.5%.
Therefore, non-compliance with the rule will cost R$ 130.16, but this amount may increase depending on overweight. But it doesn't end there, drivers can also earn up to 4 points in their license. In addition, the technical weight limit per axle must be in a visible place on the vehicle and on Renavam.
According to the new law, the fine for infractions carried out in vehicles belonging to legal entities, such as companies, whose driver was not identified, becomes double the original amount. That is, in case of a serious fine, whose value is R$ 195.23, the fine will cost R$ 390.46. Before, this number was multiplied by the number of times the vehicle committed the same offense in the last 12 months.
The new rule concerns the suspension and revocation of the National Driver's License (CNH). Previously, even if the driver filed an appeal, the CNH would remain blocked until the process was completed. However, now the drivers continue with the license until the conclusion of the analysis of the appeal and only when the defense is rejected, will there be the impeachment.
As has been said, one of the changes will only come into effect from January 2024 and this will extend the responsibility for CNH suspension to other bodies. Currently, only the Detran of each state can do this, but the change will allow road and municipal agencies to do it as well.
