Founded in 1995, TIM is present throughout the Italian territory and is considered one of the main information technology companies in Europe. In addition to Italy, TIM also operates in other Latin American countries, including Brazil.
However, his record was not enough to avoid a millionaire fine, since his performance was against the law, caused by abusive telemarketing. According to Procon, the company failed to comply with the Consumer Protection Code and State Law No. 4,896/06.
This happens when the company promotes telemarketing active outside the allowed hours, even after the customer registers his telephone number in the privacy list.
Sanction on TIM
Procon instituted a sanctioning act against the company in July 2022. It was decided to abstain from offers of products and services through active telemarketing for consumers who joined the registration of privacy, on the days and times prohibited by State Law nº 4.896/06, or who requested the blocking of these calls by the website naomeperturbe.com.br.
So far, the company has not presented a defense to the alleged violations, and has not yet complied with the requirements of the precautionary measure. For this reason, Procon-RJ filed a lawsuit with the Court of Justice of the State of Rio de Janeiro to prohibit the abusive practice.
“State Law nº 4.896/06 guarantees in the State of Rio de Janeiro the right to privacy for consumers in relation to receiving offers of products or services by telephone. Active telemarketing calls made before 8 am and after 6 pm, and on weekends and holidays, are prohibited,” said Cássio.
