Approved in 2008, the Prohibition is still questionable by Brazilians, mainly of those who refuse to carry out the test to verify the level of alcohol present in the body. Many lawsuits run through this dangerous mixture of drink and traffic. But, last Thursday, the 19th, the STF maintained the text of Prohibition, stating the punishment for any driver who refuses to take the breathalyzer test.

Prohibition has been the subject of debate since its enactment, since the issue related to the amount of drink per person being totally zero ends up penalizing several people, including those who drank only one glass.
Another question that is always asked is the fact that some people refuse to perform the test. This past Thursday, the STF court analyzed the arguments of those who questioned the constitutionality of the text, stating that there was something capable of disrespecting the right not to produce evidence against yourself.
After the analysis, the STF upheld the law. The Court understood that there is nothing unconstitutional, since in other countries the true law is known in terms of rigor with regard to alcohol consumption. With that, the minister stated that the safe consumption of alcohol to drive a vehicle is zero.
The well-known norm aims to make people aware of the danger of driving after drinking alcohol. Thus, if the driver is caught driving after drinking alcohol, he is penalized with a very serious fine in the amount of R$ 2,934.70.
In addition, the driver can have his driver's license revoked and serve six months to three years in prison if drunkenness is found. If he refuses to make the test, he may also suffer penalties.
Thus, drivers need to be aware of the accidents caused by the dangerous mix between drink and traffic and the importance of the law. According to data, after the enactment of the law, the number of deaths caused by drinks had a reduction of 11.7%. Prohibition has its explicit meaning and its responsibility for the social good.
