Health conditions also entitle to disability retirement

Disability retirement is one of the main benefits granted by the National Institute of Social Security (INSS). Nowadays, the so-called Permanent Disability Allowance, as the name suggests, is a pension granted to those who can no longer work and are permanently disabled. By disability retirement

The characteristic of disability retirement stems from the fact that it is a supplementary benefit granted to workers who are unable or no longer able to perform their duties. Remembering that this disability must be evaluated and confirmed by a specific medical opinion from the INSS.

However, disability retirement is not the same as sickness benefit, because the latter is transitory and the worker may be able to return to work again, ceasing this right. Disability retirement, on the other hand, is a social security benefit granted to workers who are no longer able to or cannot perform their work tasks permanently.

The illnesses that qualify for this pension

First, it is worth noting that it is not only the insured person's illness that guarantees disability retirement, as it is necessary for the insured person to be considered disabled to carry out work. However, it is not any illness that can guarantee the right to disability retirement.

In this way, the insured person must be permanently prevented from exercising his profession, as long as this worker's disability prevents him from practicing any other activity.

Requirements

Thus, it is important that the individual meets all the following requirements necessary to guarantee the right to receive this retirement, namely:

  • Being permanently unable to work (proved by INSS expertise);
  • Be insured (that is, be a contributor to the INSS);
  • Have contributed for at least 12 months to the INSS before becoming incapacitated (minimum waiting period to apply for any INSS benefit).

List of diseases that exempt the deficiency

Although there is no definitive list of illnesses that may qualify for disability retirement, the legislation establishes a list of diseases that do not require the length of service to obtain the benefit.

To begin with, if the insured person is affected by one of these diseases, he will not be required to contribute to the INSS for at least 12 months to receive the disability benefit. These diseases are:

  • Malignant Neoplasm;
  • Blindness;
  • Irreversible and Disabling Paralysis;
  • Severe heart disease;
  • Active Tuberculosis;
  • Severe Nephropathy;
  • Leprosy;
  • Mental Alienation;
  • Multiple sclerosis;
  • Severe liver disease;
  • Parkinson's disease;
  • Ankylosing Spondyloarthritis;
  • Paget's disease;
  • AIDS;
  • Radiation contamination.
