What are heinous crimes?

The concept of heinous crime was implanted in our legislation in 1990. At the time, the then president of Brazil, Fernando Collor, sanctioned the crime by law 8072. However, many people do not know what the term actually means.

To understand the meaning, we will start with the concept of hideous. The word means something filthy, loathsome, abominable. Therefore, a heinous crime is something that shocks society with such repugnance.

This does not mean that other violations are not reprehensible and cruel. And yes, heinous crimes are those in which criminals show complete disregard and disrespect for human existence, as well as the values ​​of humanity.

The establishment of this category of crime was carried out to separate the infractions by severity, in order to receive a sentence equivalent to the crime committed.

Examples of heinous crimes

Since its inception in the 1990s, the law has undergone several modifications, and may still pass. This is because society functions as a living organism, therefore, as it changes, new crimes may enter the category, or changes in penalties may occur, among others. The following crimes are considered heinous:

  • Robbery (robbery followed by death);
  • Epidemic with death;
  • Genocide;
  • Rape;
  • Some forms of homicide, such as extermination or aggravated homicide;
  • Extortions with kidnapping and death;
  • Irregular manipulation and adulteration of medicinal and therapeutic products;

A differentiation of these crimes from the others is that they are not subject to bail, that is, criminals cannot leave jail without awaiting trial and serving their sentences. The duration of the sentence is also changed.

In addition, there are some transgressions that are not considered heinous, but receive similar treatment, determined by the Federal Supreme Court. They are called equated crimes, and some of them are the crimes of drug trafficking, terrorism and torture.
