In the age of the internet, cyberattacks have become almost commonplace. These are attempts by hackers to damage or destroy a network of systems. In addition, these violations can cause sensitive data to be stolen and exposed and cases of identity theft, extortion, among others. In this sense, Lojas Americanas suffered a “security incident” recently and the websites of its brands (Americanas, Submarino and Shoptime) were offline for several days.

However, the company was notified by Judge Maria Cristina de Brito Lima, from the 6th Corporate Court of Rio de Janeiro, in a public civil action filed by Ibraci (Brazilian Institute of Citizenship), which used the General Law for the Protection of Personal Data (LGPD) to demand from the company more information about the incident.
Americanas claimed to the court that it had hired “world-renowned specialists” to deal with the hacker attack it suffered. However, the company denies that there has been any data leakage, stating that "there is no technical evidence that there has been compromise of personal databases of consumers".
However, after Americanas’ statement, Ibraci stated that the company’s response was “lack, incomplete, vacillating and useless", in addition to not proving "the origin of the incident and nothing informs about the degree of compromise of consumer data".
Lawyer Gabriel de Britto Silva — who also signed the petition — said that “despite being summoned to clarify the possible leak of consumers' personal data, Americanas did not bring any proof whatsoever, including technical proof of systems, IT and technological".
So far, the judge has not ruled on Americanas' response or on the Institute's comment. The company is represented in the action by Tozzini Freire Advogados, and Ibraci, by Jund Advogados Associados.
