The author of this proposal is called Joceval Rodrigues.
He explains that this idea aims to protect children and adolescents but also aims to obtain consent from parents or guardians so that this activity can be carried out. According to Rodrigues, it is essential to prevent the activity from creating problems related to school attendance.
The author points out that this project is seeking to “prevent family members, relatives and friends from taking advantage of economic impact of talented children and teenagers who dedicate part of their time to influencer activity digital". And he adds: “to protect the right of personality, notably the right to the image of these aspiring celebrities”.
Another point highlighted by Rodrigues is that the French National Assembly already approved in 2020 a law on the protection of the rights that young youtubers have in France.
The rules imposed by the proposal in the exercise of the digital influencer activity consider the existence of some cumulative documentation that needs to be presented whenever they are needed. For example:
Still according to the information in the project, income from equity, monetization of views and everything related to this – that has been obtained by carrying out this activity – need to be be deposited in a specific account that must be opened in the name of the child digital influencer, duly represented by their parents or whoever is their responsible.
Sponsors and other advertising collaborators who are not respecting this specific account deposit rule will receive a fine of up to thousand basic food baskets, which will be calculated on the value disclosed by Procon and practiced in the capital of the state where the child or adolescent live.
These fines will need to be deposited in a social solidarity fund or similar, also in the County where the influencer lives. The proposal will still be analyzed conclusively by the Social Security and Family commissions; of Labor, Administration and Public Service; and Constitution and Justice and Citizenship.
