Judge Nelson Bueno do Prado, rapporteur for the action, considered that the targets were unattainable, which forced the employee to buy items that should be offered to customers. Therefore, he considered that the company should indemnify the employee for moral damages.
After Petz filed an appeal, the judge upheld the amount of R$10,000 for moral damages, considering the size of the company, which exceeds R$1 billion, and the pedagogical nature of thepunishment. However, material damages were reduced from R$3,200 to R$1,700.
In response to the TRT-2 decision, the Petz Group communicated that the process is being analyzed by the company's legal body and the action that gave rise to the process is an isolated fact.
The company reinforced that it strictly follows good commercial practices and that what happened is not consistent with the values that guide its operations.
Petz, formerly known as Pet Center Marginal, is the largest chain of pet shops in Brazil and was founded in 2002 by Sergio Zimerman in São Paulo.
Currently, it has more than 165 stores in 18 states and the Federal District, offering a variety of services and products for pets and domesticated exotic animals.
In September 2020, the company's shares (PETZ3) began to be traded on B3, with a significant appreciation on the first day of quotation.
The TRT-2 decision highlights the importance of ensuring fair and proper working conditions for employees, protecting them from abusive targets and unfair practices.
