Lawyers for Richard Tulecki said the fall resulted in serious injuries, including a post-operative perforation of the colon. The lawsuit filed against Burger King in January 2021 alleged negligence on the part of the company by failing to ensure the safety of the establishment's area and floor.
After deliberation, a Broward County jury awarded Richard Tulecki $7.8 million, including $3.35 million for lost earnings and $700,000 for medical expenses.
Later, the court adjusted the award, reducing the amount to $7.68 million to take into account the medical expenses already covered by Tulecki's insurance.
