The case took place at a branch of the fast food chain in the state of São Paulo. Understand the situation now.
According to witnesses, the case happened because the employee failed to meet the goals set by his supervisor. To reach them, the employee needed to perform certain tasks in a time defined by the supervisor.
When the employee failed to meet the goal within the deadline, punishments occurred. Sandwiches provided as snacks had no meat or only came with two slices of bread, for example.
In addition, there were reports that the employee was placed in a cold room for differing opinions on football-related matters. This information was disclosed by the Labor Court (TRT) of São Paulo.
According to the conviction of the Regional Labor Court, the case can be classified as moral damage. The actions suffered by the employee were capable of violating off-balance sheet rights, such as honor, decorum and dignity. The amount of the fine was set at R$ 7 thousand, however, Burger King appealed the decision.
The amount of compensation was stipulated from a few points. Thus, the extent of the damage caused, the economic capacity of the fast food chain and the pedagogical character of the penalty were taken into account.
Burger King released a statement about the case. In it, the company informs that “it prioritizes compliance with labor standards and has clear people management policies, which are disclosed with all leadership and employees”.
In addition, Burger King stated that the company is dealing with the entire process in the judicial sphere. Although he has already appealed against the decision, so far the sentence has not been reviewed by the court.
