Currently, the baby's provisional custody is with the father, and this delicate case has been accompanied by Justice in Maringá, Paraná. The mother expressed her intention to appeal the decision, in search of a solution that would allow her to continue living together and raising her son.
She is outraged by the situation, mainly because the baby's father chose to leave the child in the care of a daycare center during the day so that he could work.
According to the judge's determination, Josiane is authorized to see the baby only for three hours a day, on alternate weekends. On these occasions, on her days off, she makes a point of picking up the baby from daycare and making the most of the time allowed.
Josiane emphasizes that her fight is directed exclusively at the decision of the Court and is not directed at the child's father. For Justice, the mother works too much.
In the decision of the 2nd Family and Succession Court of Paraná, the argument cited is that the mother, Josiane, “has a routine of delicate work”, and for that reason, “it is not possible to understand that she will be able to take responsibility for the child all days".
This argument justified the decision that the provisional custody of the child was given to the father. Josiane expressed that she would consider changing professions without hesitation in order to obtain custody of her son.
However, she emphasized that the benefits and salaries accrued from her decade-long career are essential to the child's well-being, including child care and health insurance.

She pointed out the injustice of being discriminated against for her profession in the 21st century and questioned whether only certain jobs can play the role of a mother, when they want to be with their children in time integral.
The main person responsible for the case mentioned that several professions, such as nurses and doctors who work on an on-call basis, are also worthy and deserving of having custody of the children.
Under the legal bias, for the lawyer Ana Lúcia Dias, the sentence can be interpreted as a punishment to the woman, configuring a form of gender violence.
Ana Lúcia argues that a mother should not lose custody of the child simply for acting as a flight attendant, unless the father is available for full care of the child at all times. According to her, the judge's decision is considered violent in this context.
