Attention in traffic: fine of R$ 880 has scared motorcyclists

Motorcyclists, beware! A law established by the Brazilian Traffic Code (CTB) does not allow motorcycles to be pushed on highways or pedestrian crossings. On the other hand, there are two specific cases that guarantee the exception to the penalty. In cases of problems with the motorcycle, the interpretations of the infringement could be diverse. Understand what the law says so you don't end up having to disburse a lot of money.

The interpretation of the act has caused a lot of damage to motorcyclists, as several of them are still guaranteed in part by the law. With the motorcycle in poor condition, even if he was pushing it, the motorcyclist could not be taken as a pedestrian just because he was not mounted on the vehicle.

Therefore, the punishments established by the code are still valid, even due to the fact that it is not allowed to push the vehicle in pedestrian crossings, especially without wearing a helmet.

This was a recently changed rule, which made the situation a little more favorable for motorcyclists. It is up to the driver to push the motorcycle in any problematic situation, as the fine will not be applied.

As? This will depend on the case.

In which cases is it allowed to push the bike?

In order not to be fined, as stated by the CTB, the citizen can push the motorcycle on public roads only when there is an electrical failure or mechanical failure. When at least one of these problems is found, the rider can push the motorbike, as you will be considered a pedestrian, no longer a motorcyclist.

In cases of non-compliance, that is, when there is no electrical or mechanical breakdown, the driver may be fined up to R$ 880.41 and receive seven more points on the National Driver's License (CNH).

Passage on footbridges, sidewalks and bike lanes is still prohibited. Riding without a helmet or any other situation other than the exceptions above will entail the risk of punishment as this is a very serious infraction.
