IR exemption for retirees and servers: Learn how it works

Although many Brazilians do not know it, there is a possibility that exemption from income tax for retirees and civil servants with specific illnesses. In this sense, check now which are the cases in which you can request the exemption and how to carry out this procedure.

Income Tax Exemption (IR) – Who is entitled?

Municipal, state and federal civil servants, in addition to retirees, may request exemption. However, it is necessary to fulfill some requirements that the Federal Revenue establishes. In this sense, these citizens need to fit some criteria and health conditions.

List of diseases that qualify for exemption from the IR

In addition to serious illnesses, such as cancer, degenerative diseases and heart disease, there are other types of problems that qualify for income tax exemption. So check out the list and make sure you have any of them:

• Illnesses caused by work;
• Tuberculosis in active phase;
• Malignant neoplasm (cancer);
• Leprosy;
• Parkinson's disease;
• Mental alienation;
• Severe nephropathy;
• Disabling paralysis;
• Osteitis deformans in advanced stages;
• ankylosing spondyloarthritis;
• non-symptomatic HIV and AIDS;
• Radiation contamination.

Important information to ensure you obtain the benefit

• First, an official report is not necessary. Therefore, the disease can be proven through reports, certificates and private examinations;
• If the exemption is granted from the date on which the request was made, the beneficiary can enter with a lawsuit in order to receive retroactive tax payments from the date of diagnosis of the disease in against;
• It is not necessary that the reason for retirement was due to disability;
• People who receive a death pension are also entitled to exemption;
• In the event of death, the heirs have the right to request a refund of the IR;
• The exemption also includes private pension;
• Finally, there is no need to make an administrative application.

How and where to apply for the IR exemption

The request can be made online. Therefore, the interested party will only need to go to an INSS agency if he is called to carry out an expert examination.
