Now, Temer appears in a new important case, which involves Gradiente and the brand Apple. The case was resumed last Friday (13). According to the information, the incident is due to a dispute over the exclusive use of the name “iPhone” in Brazil.

O STF is currently divided between decisions for this specific case due to the scope of the name in Brazil. This is further reinforced by current case law which indicates that Gradiente is entitled to use the expression “Gradiente Iphone”.
The brand would have been registered with the National Institute of Industrial Property (INPI), during 2000 and approved in 2008. However, the STF ministers understand that granting name exclusivity to the Gradiente brand, represented by Michel Temer, could affect free competition in the national market.
This is due to the fact that Apple's name iPhone is used worldwide in recognition of devices created by the North American brand. Therefore, it is believed that the release of use is for “Gradiente Iphone” for Gradiente and the use of “iPhone” is only for the Apple brand.
