Justice authorizes 123 Milhas customers to request refund of purchase on credit card; know more!

The Minas Gerais Court issued a decision that grants customers injured by the company 123 Milhas the right to request the refund of purchases made through credit cards on the travel agency website.

The basis for this decision is based on article 477 of the Civil Code and the fundamental rights of consumers, since there was a breach of established contracts.

These measures were established in response to an appeal from the National Consumer Protection Institute (Inadec), which contested the decision of the 1st Business Court of the District of Belo Horizonte, published on 10 December.

Inadec argued that, in cases where customers have been harmed due to blatant contractual violations, interruption of payments for services that will not be provided.

The National Institute also requested the resumption of the reversal procedure, arguing that this action did not directly interferes in the judicial recovery process, since it is a precautionary measure, not a constriction.

It is worth mentioning that the group's judicial recovery 123 Miles is temporarily suspended, after canceling thousands of purchased tickets.

Additionally, judge Alexandre Victor de Carvalho, from the 21st Specialized Civil Chamber of the Court of Justice of Minas Gerais (TJMG), ordered the suspension of transfers of chargebacks, that is, refunds, to 123 Miles.

In his decision, the judge highlighted that the investigation into the company's partners is ongoing.

123 Miles suspended tickets in August

In August this year, 123 Milhas stopped issuing airline tickets, even affecting those who had already made payments for trips scheduled until the end of December this year.

The action took many consumers by surprise, resulting in more than 150 complaints registered with the Civil Police, which is investigating the case.

The complaints filed involve a series of crimes that violate the Consumer Protection Code (CDC) and include accusations related to financial pyramid schemes and even embezzlement.
