In a new ordinance, published this Monday (23) in the Official Gazette of the Union (DOU), the Ministry of Education (MEC) establishes new rules for analysis of ‘judicialized’ administrative requests (being processed in court), with a view to opening or expanding vacancies in courses medicine.
For cases involving 'judicialization', the MEC document clarifies that, for these, the criteria for pre-selection of municipalities, already explained in the notice, will be considered ( https://www.gov.br/mec/pt-br/media/edital-chamada-publica-cursos-medicina.pdf), which deals with the selection of proposals for authorization to operate medical courses nationwide.

“The criteria were established to comply with the preliminary decision handed down by the Federal Supreme Court, of August 7, 2023, in Direct Constitutionality Action 81, which determined the MEC the continuation of requests that have gone beyond the documentary analysis phase, but must, however, verify compliance with the rules set out in the More Doctors Law”, informed the MEC.
With regard to the decision on the feasibility of opening new courses and increasing the availability of places already existing ones, the Executive clarifies that it will be evaluated whether the municipality is included among those pre-selected in the notice of call. “Those located among the selected municipalities will continue in the regulatory analysis process to increase vacancies or open a new course.”
Another criterion emphasized in the notice concerns the offer of compensation to the Unified Health System (SUS) by the sponsor, as well as whether there is a commitment from the local health manager, in sense of offering the higher education institution the structure of services, actions and health programs necessary for the implementation and operation of the undergraduate course in medicine.
“It will also be up to the MEC to evaluate the quality of the course through evaluation on site, in order to verify whether the infrastructure is adequate, whether there is access to health services, clinics or hospitals with basic specialties essential to the student's training, the existence of targets for full-time teaching staff with master's and doctorate degrees and teaching and technical staff with the capacity to develop good quality research”, highlights the folder.
