Amnesty was instituted by the National Congress, an issue that was already foreseen in the PLC 96/2018, that is, the pardon for fines and infractions applied to companies for delaying their deliveries of the collection of FGTS and Social Security Information (GFIP). PLC 96/2018 is a project that was approved by parliamentarians, but soon after it received the veto of President Jair Bolsonaro (veto 71/2021). In order to restore the amnesty, senators and federal deputies overturned the presidential veto last Tuesday, July 5th.

In the vote held in the Chamber, 414 deputies were in favor of overthrowing the veto. In the Senate, we had a record of 69 votes in favor of the overthrow. Now, PLC 96/2018 can be turned into law.
This project was authored by federal deputy Laercio Oliveira (PP-SE), being initiated through the course of action in the Chamber, then analyzed by the Senate and returned to the Chamber, where it was approved. Soon after, the matter ended up being sent for sanction by the Presidency of the Republic. Bolsonaro, however, ended up rejecting the text entirely, claiming that it was contrary to the public interest.
In the beginning, the proposal was restricted to the benefit of the period from 2009 to 2013. After approval of the substitute, then, the amnesty was extended to the fines that had been applied until the date on which the future law was applied.
Finally, this measure will not result in the return of amounts that have already been paid. The amnesty will apply only to cases that are not required to have payments from the Severance Indemnity Fund (FGTS).
