The right to maternity leave is guaranteed by law to women who work under the regime CLT (Consolidation of Labor Laws), providing financial support during the period in which they are absent from work due to the birth or adoption of one or more children.
However, there is still misinformation regarding who is entitled to receive this government benefit. This benefit applies equally to entrepreneurs operating under the Individual Microentrepreneur (MEI) category.

For entrepreneurs, the maternity leave process is somewhat different compared to women who have a CLT employment contract.
In this case, the request must be made 28 days before the birth, and the amount received corresponds to the minimum wage in force in the respective year.
In 2023, the value of the maternity salary is expected to be R$1,320.00, with the aim of guaranteeing the financial stability of entrepreneurs during this period.
The maternity allowance for individual microentrepreneurs lasts 120 days, equivalent to four monthly installments, applicable in cases of baby birth, adoption, obtaining legal custody or stillborn.
Find out how to request the benefit!
According to guidance from specialist Dora Ramos, who works as an accountant and is CEO of Fharos Contabilidade e Business Management, mothers who act as MEI must follow a set of steps to request this benefit.
It clarifies that the procedure begins with access to the Social Security website to register in the INSS system or through the application My INSS.
Subsequently, it is essential to complete the maternity pay requirement. It is important to highlight that, at this initial stage, it is not necessary to go to a Social Security agency.
Specialist Dora Ramos highlights the importance of meeting some requirements to be entitled to maternity benefit.
She emphasizes that the mother needs to be up to date with her monthly MEI contributions, having paid the DAS (Simples Nacional Collection Document) correctly for a minimum period of 10 months consecutive.
Furthermore, it is essential to prove both the MEI status and the pregnancy or adoption of the child.
After the request has been duly completed and documented, the INSS will schedule the granting of the benefit.
In this process, MEI entrepreneurs must present an original document that contains their photograph, as well as their CPF number.
It is also necessary to provide proof of payment to the INSS, such as payment slips, and present the child's birth certificate, in the case of birth.
In the case of adoption, the document issued after the court decision must be presented, as explained by Dora Ramos.
