However, nowadays many MEIs work alone and have a second occupation with a formal contract, following the CLT regime.

For these people, a simple question often reverberates: can a person receive labor benefits such as PIS and FGTS even though they have an active MEI?

The labor rights of MEIs who have a CLT contract

Workers with a formal contract who have an active MEI can receive PIS and FGTS, as long as their employer complies with their obligations. The fact of being an Individual Microentrepreneur does not preclude the right to receive salary bonuses from these people.

For the MEI, which is also a CLT, to be subsidized with the PIS, you just need to have a CTPS (Work and Pension Card Social) for at least five years and spend 30 days or more with a formal contract in the base year for calculating the benefit.

In case of FGTS, the worker needs his employer to make the monthly payment of the benefit fee. The amount is then allocated to a special account and can be withdrawn if the professional is fired without just cause or is in other situations that also allow withdrawal.

What about unemployment insurance?

Every Individual Microentrepreneur who has a CLT contract in parallel can also receive unemployment insurance installments if they are fired without just cause.

However, those who are only MEI are not entitled to the benefit, which is only for work purposes and not for social security.
