The 1988 Constitution is the country's largest legal instrument to protect women's rights. The Constitution declares that women are equal to men in all aspects of the law, and clearly states in the article 5 of the second part that “according to this Constitution, men and women have rights and obligations equals".
The law stipulates that women have 120 days of paid maternity leave and men 7 days of paid maternity leave.
One of the greatest advances in the fight for the rights of Brazilian women is Law nº 11.340/2006, enacted on August 7, 2006, also known as Lei Maria da Penha. She is a pioneer in creating legal mechanisms to contain domestic violence against women.
The Maria da Penha Law divides violence against women into the following categories: domestic violence, sexual violence, physical violence, moral violence and psychological violence.
