A 73-year-old woman had been missing for 44 years and was found last Wednesday (8) by the police. The Ministry of Labor assesses whether the elderly woman was working in conditions similar to slavery after the testimony, as she guarantees that she worked for 20 years at the Hotel Pieta and that she received between R$ 25 and R$ 50 weekly. The agency's review is still ongoing and the case has not been concluded.
Vanius Corte, regional manager of the Ministry of Labour and Employment (MTE), states that the elderly woman's testimony was of great relevance. According to records, the woman worked regularly between 1986 and 2000, with a formal contract. After 2000, the woman was dismissed and stated that she continued working in the company's cleaning area.
“In 2000, she was in another room inside the hotel and she moved into that room. But she kept working. She said that she worked from Monday to Monday, that she had no time off during the week, she worked from 6 am to 4 pm, with an hour break”, said Vanius Corte.
Hotel Pieta, on the recommendation of lawyer Flávio Green Koff, claims that the woman worked with a formal contract until 2000 and who continued to live in the company as a family member and because there was no one to occupy the position of cleaning.
To be considered work analogous to slavery, as stated by the Court, at least one of the situations provided for in article 149 of the Brazilian Penal Code must be practiced:
“One of the conditions is degrading work. And then this definition of what degrading work is, under what conditions it exists or not, has a lot to do with our note. Not all (requirements) need to be present. Being present one of them already characterizes. If you have one of them, it can characterize work analogous to slavery.”
