The change in relation to the suspension of the portfolio is in the number of points. Now, it is no longer related to the accumulation of points, but to the severity of the fine. That is, if the driver receives two very serious fines and adds 20 points, then he will have his license suspended.
Thus, the Brazilian Traffic Code leads to the suspension of the CNH, if the driver has excessive violations within a period of 12 months. Thus, if the driver is caught in an irregular situation, according to article 256, item II, of the traffic code, he must have his license blocked.
As a punitive measure for transgressive conduct, the suspension period lasts around 12 months and, after that time, the driver can restore the right to drive again.
Another change in the traffic code determines that companies that own vehicles must pay an extra amount in fines when there is no indication of the offending driver.
Thus, the indication of the driver who violated the rule should be mandatory in cases of vehicles registered by legal entities. This is because the infraction is directly related to the license of the driver responsible for the vehicle at the time of the infraction.
With this, if the driver commits a serious infraction, the individual fine is R$ 195.23, but if he does not identify himself, the fine for the company will be in the amount of R$ 390.46.
