Its wording describes the criteria of responsibility and rigor for the control of alcohol consumption by people driving transport vehicles. In summary, she points out that it is completely forbidden to drink any amount of alcoholic beverages to carry out this activity.
The law, mild at first and later updated, was enacted with the aim of reducing traffic accidents caused by drunk drivers. This is because alcoholic beverages generate a dysfunction in the body, altering the behavior of nerve cells.
The consequences of this consumption are changes in visual ability, reasoning, as well as changes in perception and motor coordination. Given this, the use of alcohol can lead to material damage, accidents and perhaps something more serious, leading to death.
The Ministry of Health, through the Mortality Information System (SIM), published research indicating that, after the creation of Prohibition, there was a reduction approximately 14% of the number of deaths from traffic accidents in the country. This is compared to the years 2016 to 2014.
However, even in the face of the reduction, according to a survey by the World Health Organization (WHO), in 2018, the Brazil was ranked as the third country in the world with the highest number of deaths in traffic accidents by year. The Brazilian nation was second only to vice China and leader India.
Together with the sanction of the law, several campaigns were carried out aimed at raising awareness and changing the habits of Brazilians.
Legislation has become stricter, with zero alcohol percentage tolerance.
In 1997, according to the new CTB, 0.6 g/L in the blood or 0.3 mg/L in the breathalyzer was allowed. In 2008, under Prohibition, 0.2 g/L in the blood and 0.1 mg/L in the breathalyzer were acceptable. However, from 2012, with the New Prohibition Law, any concentration of alcohol is considered an infraction.
Among the updates to the legislation is the fact that the authority is allowed to identify drunkenness, just through changes in the driver's ability or even via images, videos and testimonials.
However, confirmation requires several signs, as well as the description in the infraction notice. In addition, even if the person refuses to take the test, he can be punished, just like the driver who was proven to be drunk.
And it's not over. Another restriction is regarding the sale and distribution of alcoholic beverages on federal highways, or in areas with direct access to highways. Therefore, the sale of these drinks is prohibited and, if the limitation is not complied with, the person responsible will be punished.
In view of this, the Blitz, sudden inspections in the streets against illegalities, became quite common as an attempt to control the infraction.
Allied to them are the breathalyzers, electronic object that drivers are instructed to blow through a straw, so that it makes the measurement of the amount of alcohol in the air that is expelled and thus conclude the existence or not of the substance.
They have become essential instruments in punishment, in addition to being evidence against offenders, as it demonstrates the percentage present in the body.
In the event of retail sale or offering of alcoholic beverages, in the right of way with direct access to the highway, a fine of R$ 1,500.00 will be applied.
In cases of blitz, in which the driver of the vehicle is identified with any level of alcohol, he receives a penalty for what happened. Because no content is allowed, this fine is classified as very serious penalty.
The amount of the penalty can be BRL 2,934.70, with the mandatory seizure of the car and suspension of the right to drive for 12 months. In addition, there is the possibility of detention for a period of between 6 and 12 months.
In addition, if the driver repeats the infraction, within a period of one year, the fine will be doubled (R$ 5,869.40) and the CNH may be revoked.
If alcoholic beverages are consumed, it is best to take a ride, ask for a taxi or an app driver. However, if you still have the need to drive the vehicle, it is recommended to wait a while before driving.
According to experts, the time it takes the body to absorb alcohol depends on many factors: whether you are a man or a woman, your weight, the amount of alcohol ingested, as well as the type of drink.
As there are blood alcohol tests capable of identifying it, even 12 hours after it has been consumed, it is recommended that you wait this minimum time. However, the more you drink, the longer the waiting period should be. In cases of high consumption, it is recommended to wait at least 24 hours.
