What are the rules for granting unemployment insurance?

Unemployment insurance has a varied set of rules, including the period worked that gives entitlement to the benefit, according to the following requirements:

  • have worked at least 12 months in the last 18 months immediately prior to the date of dismissal, when the first request was made;
  • having worked at least 9 months in the last 12 months immediately prior to the date of dismissal, at the time of the second request; It is
  • having worked each of the 6 months immediately prior to the date of dismissal, at the time of the other requests.

Who is entitled to receive unemployment insurance?

The benefit is granted to six different groups, in addition to taxpayers governed by the CLT:

  • Formal and domestic worker, due to dismissal without just cause, including indirect dismissal;
  • Formal worker with suspended employment contract due to participation in a course or professional qualification program offered by the employer;
  • Professional fisherman during the closed period;
  • Worker rescued from a slave-like condition.

How do I know how many installments I am entitled to?

The number of installments has a variation that follows the length of service that the taxpayer has provided and is granted as follows:

  • 3 installments if they have worked for at least 6 months;
  • 4 installments if they have worked for at least 12 months; It is
  • 5 installments if they have worked for at least 24 months.

How to apply for unemployment insurance?

The request for unemployment insurance must be made at the Regional Superintendents of Labor and Employment (SRTE), Special Secretariat of Social Security and Work (SEPT), National Employment System (SINE) or at other points made available by the Ministry of Labor and Social Security, to know:

  • Portal Gov.br;
  • Digital Workbook Application, available for Android and iOS;
  • In person, at the units of the Regional Labor Superintendencies, after scheduling an appointment through the 158 call center.

How much is unemployment insurance?

The value of the benefit depends on the length of service provided by the taxpayer, and also on the number of installments he will receive. In 2022, the values ​​will be these:

  • Average salary of up to R$1,858.17: the value of the installments will be 80% of the average salary or minimum wage, whichever is higher;
  • Average salary from BRL 1,858.18 to BRL 3,097.26: the value of the installments will be 50% on whatever exceeds BRL 1,858.17, plus a fixed amount of BRL 1,486.53;
  • Salary above BRL 3,097.26: in this case, the installments are invariable with a fixed amount of BRL 2,106.08.

Is there a deadline to apply for unemployment insurance?

Yes, the interested person needs to follow the grace period, which is counted from the date of dismissal. It has a variant character from some cases:

  • Formal worker: from the 7th to the 120th day, counting from the date of dismissal;
  • Qualification grant: during the suspension of the employment contract;
  • Domestic worker: from the 7th to the 90th day, counting from the date of dismissal;
  • Artisanal fisherman: during the closed season, within 120 days of the start of the ban;
  • Rescued worker: up to the 90th day, counting from the rescue date.

What documents should I submit to approve my unemployment insurance?

  • Unemployment insurance guides;
  • PIS/Pasep card, updated statement or Citizen's Card;
  • Employment and Social Security Card – CTPS;
  • Employment Contract Termination Term;
  • Identification documents: Identity card, Birth certificate, Marriage certificate with protocol of application for identity, national driver's license, work permit, passport or certificate of reservist;
  • Last three paychecks, relating to the three months prior to the month of dismissal;
  • Document that lists FGTS deposits or extract of deposits;
  • Proof of address;
  • Schooling certificate.
