Prison aid is granted to dependents of the INSS insured person who is in a closed prison regime. It is also valid for semi-open policyholders, if the arrest occurred before January 17, 2019. Dependents of open prison inmates are not entitled to this benefit.
The maximum amount of imprisonment benefit corresponds to a minimum wage and is paid monthly to dependents while the insured person is serving his sentence. As soon as the insured is released from prison, payment of the benefit ends.
The insured must have contributed to the INSS in the last 24 months before being arrested. In addition, he must be considered low-income so that his dependents are entitled to incarceration assistance.
The prisoner benefit cannot be receiving another INSS benefit at the same time. This includes benefits such as retirement, maternity pay, death pension, among others.
Dependent family members who can receive the confinement benefit include a spouse or partner, children under 21 years of age, disabled children or children with intellectual, mental or severe disability, parents of the insured and siblings under 21 years of age, or siblings who are disabled or have intellectual, mental or serious.
To request confinement assistance, dependents must make the request through the “Meu INSS” application or website. On the website, they must click on “New Request”, choose the “incarceration aid” benefit from the list and follow the instructions.
It is necessary to present identification documents for the insured and dependents, such as CPF, court certificate, power of attorney with documents from the representative (if applicable) and documents proving the insured's contribution time, when necessary.
