Seclusion benefit: What is it and who is entitled to the benefit?

Incarceration aid is a benefit paid by the National Social Security Institute (INSS) in Brazil. However, contrary to what many people think, it is not granted to everyone serving time in prison. The benefit is intended for dependents of INSS policyholders who meet certain criteria.

Prison aid is granted to dependents of the INSS insured person who is in a closed prison regime. It is also valid for semi-open policyholders, if the arrest occurred before January 17, 2019. Dependents of open prison inmates are not entitled to this benefit.

Value

The maximum amount of imprisonment benefit corresponds to a minimum wage and is paid monthly to dependents while the insured person is serving his sentence. As soon as the insured is released from prison, payment of the benefit ends.

Contributions

The insured must have contributed to the INSS in the last 24 months before being arrested. In addition, he must be considered low-income so that his dependents are entitled to incarceration assistance.

Incompatibility

The prisoner benefit cannot be receiving another INSS benefit at the same time. This includes benefits such as retirement, maternity pay, death pension, among others.

Eligible Dependents

Dependent family members who can receive the confinement benefit include a spouse or partner, children under 21 years of age, disabled children or children with intellectual, mental or severe disability, parents of the insured and siblings under 21 years of age, or siblings who are disabled or have intellectual, mental or serious.

Application procedure

To request confinement assistance, dependents must make the request through the “Meu INSS” application or website. On the website, they must click on “New Request”, choose the “incarceration aid” benefit from the list and follow the instructions.

It is necessary to present identification documents for the insured and dependents, such as CPF, court certificate, power of attorney with documents from the representative (if applicable) and documents proving the insured's contribution time, when necessary.

It is also important to remember that the granting of incarceration assistance is subject to strict criteria and not all prisoners or their family members are entitled to this benefit. Therefore, it is advisable to consult the INSS or a professional specializing in social security for specific guidance on your individual situation.
