First, pension for death is an aid offered to dependents of the deceased person by the INSS itself.

This aid is based on the deceased's retirement, based on his length of service and the amount he he would be entitled to until the moment of his death, thus providing his dependents with a certain security and stability.

What criteria must be observed to guarantee the pension?

So, to be entitled to a death pension, some prerequisites must be observed, they are:

  • Proven death of the beneficiary: In this way, it is necessary to prove the death of the deceased through documents that attest to this death or a death certificate;
  • Proof that the insured person was retired, was in a grace period or was receiving benefits from the INSS.
  • Status of the dependent: Therefore, it is essential to present proof to the INSS that there was a relationship of monetary dependency between the dead companion and the one who wishes to benefit from this pension.

What is Stable Union?

Stable union is the public union of two people for a long period of time with the aim of forming a family. According to the Civil Code, for this union to exist it must be: public, lasting, continuous and be formed with the objective of constituting a family.

How is it possible to prove the union?

You can use the following documents listed for this purpose, but it is important to emphasize that any other document that can actually prove the existence of this stable union is valid. Therefore, at the time of proof, present at least two of the documents below.

  • religious marriage certificate
  • joint bank account
  • Proof that the two lived in the same residence
  • Testament
  • Birth certificate, if the couple has children
  • Declaration of the deceased's income tax that presents the person who has the common-law partner as their dependent
  • Documents of medical consultations that contain the name of the insured person as responsible
  • Insurance policy in which the interested person is presented as the beneficiary and the deceased as the insurance policyholder
