INSS: after the end of the experts' strike, the delay for the expertise continues

On May 23, experts from the INSS (National Institute of Social Security) ended a strike that lasted approximately 2 months. However, the stoppage ended up causing a long delay in relation to the expert examinations that give access to the benefits that require reports, such as the sickness aid.

After the strike ended, the promise was of more agility in INSS assistance to policyholders. However, thousands of beneficiaries are still waiting in a long queue for expert examinations, which are being rescheduled for early 2023.

Therefore, policyholders who need permission for sick pay still do not receive their monthly benefits from the INSS and without their monthly salary from work, since they are on leave.

Those who are waiting for permission to receive the benefit for a period longer than that established by the MPF and INSS can take some steps. Thus, the insured must request its analysis by the Unified Center for Emergency Compliance with Deadlines.

If, within a stipulated period of 10 days, the request has not been returned and completed, the insured may request a writ of mandamus, through an injunction. Through this, the courts may determine that the INSS pays a fine to the insured person for non-compliance with pre-established deadlines.

In addition, in cases of delay, the beneficiary can contact the institute's ombudsman via telephone 135 or also through the Meu INSS platform, which is available for Android and iOS.
